FREQUENTLY ASKED QUESTIONS
ES DEBT COLLECTION.
- I will send a letter and email to the debtor with either a copy of your original invoice to them or a breakdown of the outstanding amount owed to you. I will charge you a fee of £25.00 which is payable on demand, whether or not the debt is recovered.
- If the debtor is an individual, I will increase the amount of the debt by 8% representing interest on late payment which is recoverable from the debtor and payable to you. If the debtor is a commercial debtor, I will add interest and compensation to the debt in accordance with the Late Payment of Commercial Debts Interest Act.
- I will send a chasing letter and email to the debtor after 7 days for no extra charge.
- If the debt is recovered, you will pay a commission to me which amounts to 12% of the total sum recovered.
- If you wish me to issue Court proceedings against the debtor, I will issue them on your behalf for no extra charge. The Court fee is payable by you and is recoverable from the debtor in addition to the debt and interest.
- If the debtor pays the sum without the need for a Court hearing I will forward monies to you less the 12% commission payable to me.
- If the debtor does not respond to the Court, I will obtain a County Court Judgment in default against the debtor, again, for no extra charge. This Judgment remains in place for 6 years and will affect the debtor’s credit rating.
- If you wish to commence enforcement proceedings against the debtor once the CCJ is obtained I will advise you of the options and the costs involved to pursue this through the Court.
- If the matter is disputed by the debtor at any time, and is set down for a hearing at Court, I will assist you in preparation for a Court hearing but would charge an hourly rate of £25.00 for all work effected on your behalf. Please note for debts under £10,000.00 these charges are not recoverable from the debtor even if your claim is successful at Court
- I will advise you at each step whether or not I believe it is cost effective to pursue the debtor further.
